A GUIDE TO GETTING A DIVORCE IN COLOMBIA

To obtain a divorce in Colombia there must be a current cause for divorce. There are multiple grounds for divorce and the Colombian Civil Code includes them in Article 154 of the Civil Code. If a person does not have a cause as stated in the code, the judge may reject the ground for divorce.

CAUSES OF DIVORCE

Causes of divorce may include the following:

  • Extramarital sexual relations of one of the spouses.
  • Serious and unjustified violation by one of the spouses of the duties that the law imposes on them as partners and parents.
  • Indignations, cruel treatment and mistreatment.
  • Habitual drunkenness of either spouse.
  • Habitual use of hallucinogenic or narcotic substances, except if prescribed by a physician.
  • Any serious and incurable illness, physical or mental, of one of the spouses, which endangers the mental or physical health of the other spouse.
  • Conduct by either spouse that corrupts or perverts the other, a family member, or persons under his or her care and living together in the same household.
  • Separation of bodies, judicial or de facto, that has lasted more than two years.
  • The consent of both spouses manifested before a competent judge and recognized by the latter by means of a judgment.

 

OPPORTUNITY TO FILE CASES

The spouse who is adversely affected by the actions of the other, may file for divorce within one year from the time the affected spouse became aware of the causes of the divorce they experienced. The Civil Code grants specific time periods that allow a spouse to sue for a particular ground for divorce.
